Using 511now means you accept these terms

511now is run by Henricks Media. These terms are an agreement between you and Henricks Media. By opening or using 511now, you accept them. If you do not accept them, please do not use 511now.

You must be old enough to enter an agreement where you live. If you use 511now for an employer or a group, you accept these terms for them as well.

Personal use of public information

511now shows camera photos and public data from government agencies and official sources. You may use 511now for personal, non-commercial purposes.

The camera photos belong to the agencies that run the cameras: WSDOT, ODOT, Idaho 511, the National Park Service, and the Oregon Hazards Lab. Wildfire and weather data come from the National Interagency Fire Center and the National Weather Service. Nothing here gives you a licence to those pictures or that data. If you want to reuse them, ask the agency.

The 511now name, design, words, and code are ours. Please do not copy them.

We are not WSDOT, ODOT, Idaho 511, or any agency

511now is not affiliated with or endorsed by WSDOT, ODOT, Idaho 511, NIFC, NWS, NPS, OHAZ, ALERTWest, ALERTCalifornia, Watch Duty, or any state, county, or federal agency.

We are not official state 511, and never were.

Data can be late or wrong

Camera photos, wildfire perimeters, and weather alerts are loaded from public sources. Those sources can be delayed, stale, or incorrect.

A camera photo may be minutes or hours old. Wildfire perimeters are mapped estimates, not real-time boundaries. Weather alerts can be issued, updated, or cancelled at any time. Cameras go offline, and agencies change or remove them without telling us.

Not an emergency alert system

511now does not issue evacuation orders. It does not send alerts. It does not tell you to go or to stay.

Do not use 511now as your only source for emergency information. Follow Wireless Emergency Alerts, your county emergency management office, and official 511 pages for closures and evacuation orders. If you feel unsafe, leave early.

511now is one more way to look at a road or a sky. It is not a safety system, and no picture on it should decide on its own whether you travel.

What you agree not to do

When you use 511now, you agree that you will not:

  • scrape, bulk-download, or re-publish the pictures or data, or feed them into another product or service;
  • charge anyone for access to 511now or to anything on it;
  • copy the site, frame it, or present it as your own;
  • take apart, reverse engineer, or work around any part of how it runs;
  • send it so much traffic that it slows down or breaks for other people;
  • try to reach parts of the site or its hosting that are not meant to be public; or
  • use 511now to break the law or to harm anyone.

If you want to use the camera photos or the data for anything beyond looking at them, go to the agency that publishes them. They set those rules, not us.

Other sites we link to

511now links to official agency pages and other outside sites. We do not run those sites and are not responsible for them, for what they contain, or for what happens when you use them. A link is not an endorsement.

No warranty

511now is provided as is and as available, with no warranty of any kind, express or implied. To the fullest extent the law allows, we disclaim all warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy.

We do not promise that camera photos will load, that data will be current or correct, that links will work, or that the site will be available at any given moment.

Use 511now at your own risk.

Limits on our liability

To the fullest extent the law allows, Henricks Media is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, property damage, personal injury, or loss of life — arising out of or relating to 511now or these terms, under any legal theory, even if we were told such damages were possible.

Our total liability for any claim relating to 511now will not exceed one hundred US dollars.

This covers, among other things, a camera being offline, a picture being old or wrong, a wildfire perimeter or weather alert being late or inaccurate, a road being closed or open when 511now suggested otherwise, and the site being unavailable.

Some places do not allow these limits, in particular for death or personal injury caused by negligence. Where that is so, our liability is limited as far as the law allows.

If your use causes a claim

If someone brings a claim against Henricks Media because of how you used 511now, or because you broke these terms, you agree to defend us, to pay the costs, and to hold us harmless, including reasonable legal fees.

Changes, and stopping the service

We may change these terms. When we do, we will update the date at the top of this page. If you keep using 511now after that, you accept the new terms.

We may also change, pause, or shut down 511now, in whole or in part, at any time and without notice.

Which law applies

These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts in Lane County, Oregon, and both sides agree to those courts.

The rest

If any part of these terms is found not to hold, the rest still applies. If we do not enforce part of these terms right away, we have not given up the right to enforce it later. These terms, together with the Privacy page, are the whole agreement between you and Henricks Media about 511now.
